In short
- You sell the food and are responsible for it; MyOTgo runs the app and takes payment for you through Stripe.
- Customers your restaurant brings: 0% food commission on collection orders only, with permanent restaurant attribution from a verified first QR or tracked-link visit, including later direct Food visits. Other customers and all delivery orders: 4% in months 1–4, 8% in months 5–8, then 12%, unless an explicit business rate applies. Card processing is separate: 1.9% + 20p. AI and delivery are separate.
- MyOTgo does no delivery: you deliver, or customers collect.
- Verification is optional and gives you the blue tick; accepting the agreement is needed by everyone.
1. Who it's between
The agreement is between MYOTGO TECH LTD, a company registered in England and Wales (company number 16704380), registered office 39A Brookfield Road, Northampton NN2 7LP ("MyOTgo") and the business that accepts it in the app ("you"). The person accepting confirms they may sign for the business. The version you accepted, with your own fees in it, stays available in the app (Settings → Verification and agreement) as a signed copy.
2. Fees
The fees are the ones in our business terms (sections 4 and 7), counted in calendar months on UK time from your registration (or the hand-over of a business we set up for you). The agreement lists the exact rates for your business when you accept it. MyOTgo is not registered for VAT, so no VAT is charged on its fees; if that changes we'll tell you first. Refunds return the proportional original application fee where applicable; Stripe may retain processing costs. Disputes use the original fee breakdown and are reconciled once. Changing collection to delivery requires a new quote before payment.
3. You are the seller
Your legal name and trading address are shown to customers on your page, at checkout and on receipts. You're responsible for your prices, the food, delivery when you offer it, refunds and complaints (see our Cancellation and Refund Policy), and your taxes.
4. Food safety and allergens
Your premises must be registered as a food business with the council. You keep each dish's allergens (the 14 allergens UK law lists) accurate in your menu, and answer customers who ask. MyOTgo's assistants only repeat what you declare; a dish with nothing declared tells customers to ask you.
5. Verification and the blue tick
You can ask us to verify your business. We check public records (Companies House, the FSA's food hygiene ratings) and, where needed, look at documents by hand; people at MyOTgo make every decision. Verified businesses get a blue tick and may rank a little higher in search. We may suspend a listing while we look into a serious problem; we'll tell you why.
Order claims and evidence
Businesses can see Food order claims, amounts, reasons and history in MyOTgo Business, including its website. They have seven days after a claim opens to add evidence or challenge it; further evidence can be sent to support. A person records decisions and reasons, and rejected claims can be appealed. Automated triage is advisory and never rejects a claim.
The restaurant normally bears responsibility for food it did not make, wrong food or its own driver's failure. MyOTgo bears loss by a MyOTgo-arranged driver. A self-selling driver is the seller. A person decides unclear responsibility; the restaurant is never charged automatically on an uncertain automated suggestion.
Authorised claim refunds use the existing Stripe payment: restaurant liability can reverse the transfer and return the proportional platform application fee; MyOTgo liability leaves the restaurant's transfer and application fee intact and is funded by MyOTgo. Stripe may retain its card-processing fee. Other liability, cash settlements, failed reversals and chargebacks need individual reconciliation. Consumer statutory rights take precedence.
Deliveries imported from another seller’s receipt and drivers’ own deliveries are external work. MyOTgo is not responsible for fulfilling them, requires no delivery PIN or proof, and does not handle them through MyOTgo order disputes. The driver may add an optional doorstep photo; this does not change responsibility. Raise problems with the external seller or delivery provider. Your statutory rights are unaffected.
6. The agreement itself
The full text is shown in the app before you accept it. Versions not yet reviewed by our solicitor are labelled "pending legal review" there. If we publish a new version that changes something important, you'll be asked to accept it again, with a grace period if you're already trading.
